Definitions

These terms and conditions are intended exclusively for the online sale of goods to consumers.

Buyer:

For the purposes of these Terms and Conditions, the buyer is a consumer, i.e. a person who, unlike the seller, does not act within the scope of their business activities or within the scope of the independent performance of their profession

when concluding and performing the contract (hereinafter referred to as the “buyer”).

Seller:

For the purposes of these terms and conditions, the seller is an entrepreneur who, unlike the buyer, acts within the scope of their business activities or within the scope of their independent professional activities when concluding and performing the contract (hereinafter referred to as the “seller”).

Civil Code (CC):

Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter referred to as the “Civil Code”).

The Seller undertakes to respond to written or electronic correspondence from the Buyer without undue delay, no later than within two working days.

Code of conduct:
The Seller is not bound by any codes of conduct in relation to the Buyer within the meaning of Section 1820(1)(n) of the Civil Code.

After-sales service:
The Seller does not provide after-sales service to Buyers.

1. Introductory provisions

These terms and conditions (hereinafter referred to as the “terms and conditions”) of NOVÁK – papír, s.r.o., with its registered office at Stradonice 139, 440 01 Louny, identification number: 25479831, registered at the Regional Court in Ústí nad Labem, file number: C 20080 (hereinafter referred to as the “Seller”), regulate in accordance with the provisions of Section 1751(1) of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the “Civil Code”), the mutual rights and obligations between the Seller and a natural person (hereinafter referred to as the “Buyer”) arising in connection with or on the basis of a purchase contract concluded through the online store.

For the purposes of these terms and conditions, the buyer is understood to be a consumer who is not acting within the scope of their business activities when concluding the contract. The seller expressly rejects any deviating terms and conditions of the buyer.

These Terms and Conditions govern, in accordance with Section 1751(1) of the Civil Code, the mutual rights and obligations of the Seller and the Buyer when purchasing goods through the online store paper-novak.com.

These Terms and Conditions apply exclusively to purchase agreements concluded with consumers.

2. Order and conclusion of the purchase contract

The purchase contract may be concluded in the Czech language. Orders may be placed via the web interface. The purchase contract is formed upon acceptance of the order by the Seller.

The Seller reserves the right to refuse an order in the event of incorrect data, a technical system error, or doubts about the Buyer’s identity.

An order constitutes a proposal to conclude a purchase contract. The contract is concluded upon confirmation of the order by the Seller.

The Buyer acknowledges that by clicking the “Order with obligation to pay” button, they place a binding order.

3. Price of goods and payment terms

Prices are stated excluding VAT. The total price including VAT and any additional fees is always displayed before completing the order.

Payment methods: cashless bank transfer, cash on delivery (if available), or advance invoice. Payment is due within 14 days unless agreed otherwise.

A tax document will be issued after payment is made and sent electronically or by post within 14 working days.

4. Delivery terms

Goods are delivered via transport services to the address provided by the Buyer. The Buyer is obliged to accept the goods and inspect the integrity of the packaging upon receipt.

The Seller dispatches the goods within 5 working days unless stated otherwise; for goods in stock, within 2 working days.

If the Buyer fails to accept the shipment without a serious reason, a storage or re-delivery fee may be charged. The risk of damage passes to the Buyer upon receipt of the goods.

Ownership of the goods passes to the Buyer upon full payment and receipt of the goods.

5. Withdrawal from the contract

The Buyer has the right to withdraw from the contract within 14 days of receiving the goods without stating a reason. The goods must be returned undamaged, preferably in the original packaging. The cost of returning the goods shall be borne by the Buyer.

The right of withdrawal does not apply to goods modified according to the Buyer’s wishes or to goods subject to rapid deterioration or hygiene conditions.

The Seller is not obliged to refund the Buyer before receiving the returned goods or proof that the goods have been dispatched. The Seller shall refund the paid amount within 14 days of receiving the returned goods or proof of dispatch.

The Seller shall refund the paid amount to the Buyer without undue delay, no later than within 14 days from the moment the returned goods are received or the Buyer proves that the goods have been sent.

6. Rights arising from defective performance

The Seller is liable for defects in the goods in accordance with the Civil Code. The Buyer has the right to repair, replacement, or a discount. Rights arising from defects may be exercised no later than 24 months from receipt of the goods.

The Buyer has the right to repair, replacement, a discount, or, in the case of a material defect, withdrawal from the contract. Complaints will be handled without undue delay, no later than within 30 days from their submission.

7. Personal data protection

The Seller processes the Buyer’s personal data in accordance with the GDPR. The purpose of processing is the performance of the purchase contract, accounting, and communication with the customer. Data may be transferred to the carrier for delivery purposes.

The Buyer has the right to access, rectify, erase, restrict processing, data portability, and to lodge a complaint with the Office for Personal Data Protection. Contact email: info@papir-novak.cz.

8. Dispute resolution

The Buyer may use out-of-court dispute resolution through the Czech Trade Inspection Authority (www.coi.cz).
Online dispute resolution is available via the ODR platform: https://ec.europa.eu/consumers/odr.
The Buyer may also seek advice from the organization dTest, o.p.s. (www.dtest.cz/poradna).

9. Final provisions

These Terms and Conditions become effective on the date of their publication on the Seller’s website. Purchase contracts are governed by the laws of the Czech Republic. The Seller reserves the right to amend these Terms and Conditions; such amendments shall not affect contracts already concluded.

The purchase contract is archived by the Seller in electronic form and is not publicly accessible.
The Buyer is advised to retain the order details and these Terms and Conditions for their own records.

These Terms and Conditions are effective as of 19 January 2026.
